The absence of Judge has stalled the hearing into the suit filed against the Niger State Ministry of Basic Education,the Director General Schools and Education Reforms in Niger State Hajiya Maimuna Mohammed and the caretaker committee of the Parent Teachers Association (PTA),<\/p>\n
The Niger State Parent-teacher Association (NIPTA), through its counsel Barrister Abubakar Sadeeq Ma\u2019aji of Ndamitso Chamber has filed a suit before Justice Mikaila Abdullahi of the Niger State High number two.challenging the unlawful dissolution of the NIPTA by the respondents.<\/p>\n
In a suit number NSHC\/MN\/446\/2025 requesting the court to declare the unlawful dissolution of the existing executive of the Niger State Parent-teacher Association NIPTA by the respondents sometimes in November 2025 which was held at the Education Resources Centre in Minna as illegal and not in compliance with appropriate law.<\/p>\n
In a motion on notice filed at the Minna High Court number two by the plaintiff applicants brought pursuance to order 93 (1) and (2) of the High Court Civil Procedures) Rules 2018 and under the inherent Jurisdiction of the Court.<\/p>\n
The Plaintiff is praying the court for an order of interlocutory injunction restraining the caretaker committee chairman and other members of the committee as constituted by the Director General, Education Schools Reforms in Niger State Hajiya Maimuna
\nMohammed from taking any step or performing any such function that will insinuate or give the committee the status of caretaker of the plaintiff pending the hearing and determination of the substantive suit.<\/p>\n
Also,the plaintiff applicant is praying for such further order as the court may deem fit to make in the circumstances.<\/p>\n
The motion on notice backed by fifteen paragraph affidavits deposed by Mallam Yunusa Adamu the current Chairman of the Niger State Parent Teacher Association NIPTA argued that the association was a duly registered as a corporate entity with the Corporate Affairs Commission <\/p>\n
Barrister Sadeeq Ma’aji also requested the court to declare the caretaker committee activities as illegal and to restrain the caretaker committee from performing any functions until the final determination of the substantive suit already in court.<\/p>\n
However, the ex- parte motion and the hearing into the suit was slated to commence Monday the 12th January,2026,\u201d only for the court clerk to come into the court room to announce the absence of the Judge for today\u201d according to the counsel to the plaintiff.<\/p>\n
Barrister Sadeeq Ma’aji wondered why the respondents are still parading themselves as the caretaker committee chairman even with the case still pending in court urging them to desist Henceforth pending the final determination of the suit.<\/p>\n
The case is now adjourned to 21th January for commencement of hearing into the both ex-parte motion and the hearing.<\/p>\n
