{"id":16280,"date":"2026-08-03T21:44:17","date_gmt":"2026-08-03T21:44:17","guid":{"rendered":"https:\/\/dailyechoes.ng\/?p=16280"},"modified":"2026-08-03T21:44:17","modified_gmt":"2026-08-03T21:44:17","slug":"justice-mohammed-of-minna-high-court-orders-hypadec-to-pay-n2-076bn-to-danu-jumu-community","status":"publish","type":"post","link":"https:\/\/dailyechoes.ng\/index.php\/2026\/08\/03\/justice-mohammed-of-minna-high-court-orders-hypadec-to-pay-n2-076bn-to-danu-jumu-community\/","title":{"rendered":"Justice Mohammed of Minna High Court orders HYPADEC to pay N2.076bn to Danu Jumu Community"},"content":{"rendered":"<p>By Uthman Baba-Naseer,Minna<\/p>\n<p>Justice Mohammed Adishetu Mohammed of the Minna High Court number four,has ordered the Hydro Electric Power Producing Area Development Commission,(HYPADEC),to pay the sum of two billion, and seventy six million naira (N2,076,000,000,00) to Danu Jumu Community in Rafi Local Government Area of Niger State.<\/p>\n<p>Delivery Judgement in suit Nos. NSHC\/MN\/ 77\/2023, filed by Umar Isah and Mohammed Attahiru through their Attorney Kabir Ibrahim Esq of the Summit Chamber,approached the Court that the plaintiffs claimed that the defendants refusal to pay compensation to the plaintiffs communities and settle them at a safer location as done to other communities in the same is unlawful.<\/p>\n<p>Joined in the suit include the Attorney General of the Federation and the Minister of Power as defendants.<\/p>\n<p>Justice Mohammed Mohammed further ordered the defendants to resettle the plaintiffs\u2019Communities to a safer location away from the site in which the Dam project was located,to pay the sum of N500,000,000,00 as general damages and   the sum of N500,000,000,00 as cost of litigation.<\/p>\n<p>While analising the judgement, he held that when the processes of \u201c this court were served on the defendants they denied liability and filed their defenses to the claims of the plaintiffs<\/p>\n<p>\u201c At the close of pleading and conclusion of pre- trial, commenced by the plaintiffs who called four witnesses while the 1st  defendant called one witness. The 2nd and 3rd defendants did not call any witness in this matter\u201d he asserted.<\/p>\n<p>However, according to Justice Mohammed Mohammed, a close examination of the witness statement  of both principal witness one and principal witness four shows that they were signed by the witnesses and deposed to before the Commissioner of oaths as attested to by the signature and official stamp of the Commissioner for oaths,on 17th of May,2024 and second October 2024.<\/p>\n<p>\u201c Following the above, I hold that the witness statements of  Pw1 and Pw4 were done in accordance with the law and  same were properly adopted before the court.<\/p>\n<p>\u201c Having held that the plaintiffs have established their claims against the defendants the sole issue raised for determination is hereby resolved in favour of the plaintiffs and against the defendants.<\/p>\n<p>\u201c Consequently,judgement is hereby given in favour  as follows.
