{"id":1888,"date":"2025-02-10T16:21:21","date_gmt":"2025-02-10T16:21:21","guid":{"rendered":"https:\/\/dailyechoes.ng\/?p=1888"},"modified":"2025-02-10T16:21:43","modified_gmt":"2025-02-10T16:21:43","slug":"rowdy-session-as-court-adjourns-nnamdi-kanus-trial-indefinitely","status":"publish","type":"post","link":"https:\/\/dailyechoes.ng\/index.php\/2025\/02\/10\/rowdy-session-as-court-adjourns-nnamdi-kanus-trial-indefinitely\/","title":{"rendered":"Rowdy session as Court adjourns Nnamdi Kanu\u2019s trial indefinitely"},"content":{"rendered":"<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">By Our Reporter<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\u00a0There was rowdy session in the Federal High High court on Monday following the heated argument\u00a0 that extended the trial of Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), indefinitely.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The presiding judge, Binta Nyako of the Federal High Court in Abuja, made the decision after Kanu challenged her jurisdiction, insisting she had recused herself from the case.<\/div>\n<div dir=\"auto\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-1890\" src=\"https:\/\/dailyechoes.ng\/wp-content\/uploads\/2025\/02\/Screenshot_20250210-163914_1-162x300.jpg\" alt=\"\" width=\"162\" height=\"300\" srcset=\"https:\/\/dailyechoes.ng\/wp-content\/uploads\/2025\/02\/Screenshot_20250210-163914_1-162x300.jpg 162w, https:\/\/dailyechoes.ng\/wp-content\/uploads\/2025\/02\/Screenshot_20250210-163914_1.jpg 382w\" sizes=\"auto, (max-width: 162px) 100vw, 162px\" \/><\/div>\n<div dir=\"auto\">In September 2024, Justice Nyako stepped away from Kanu\u2019s case after he filed an oral application expressing a lack of confidence in her handling of the trial.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\u00a0&#8220;I hereby recuse myself and remit the case file back to the chief judge,&#8221; she stated at the time.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">However, in a surprising twist, the Chief Judge of the Federal High Court, John Tsoho, returned the case to Nyako, arguing that Kanu must formally submit a motion on notice before the case could be reassigned.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The prosecution, led by Adegboyega Awomolo, later requested a date for trial in a letter dated December 5, while Kanu\u2019s legal team, led by Aloy Ejimakor, opposed the move, maintaining that Nyako\u2019s recusal was still in effect.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Ejimakor further suggested that the case be transferred to a Federal High Court in the South-East if no judge in Abuja was willing to preside over it.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">During Monday\u2019s session, Awomolo informed the court that the prosecution was ready for trial.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">However, Ejimakor insisted that the issue at hand was the judge\u2019s recusal, not the trial itself.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Justice Nyako clarified that while she did not want to preside over the case, the chief judge had refused to accept her recusal and instructed Kanu\u2019s legal team to file a formal motion for reassignment.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">As arguments ensued, Kanu interrupted the proceedings, declaring that he wanted to speak for himself.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">&#8220;I don\u2019t recognize the authority of this court to preside over my case.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">&#8220;Everything you said here is meaningless to me,&#8221; Kanu stated, expressing frustration over the handling of his trial.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">He also accused the prosecution of &#8220;subverting the law&#8221; and claimed that the judicial process was being manipulated against him.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Despite Awomolo\u2019s plea for a definite trial date, Justice Nyako ruled to adjourn the case indefinitely.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\u00a0&#8220;In light of what is happening now in court, I am going to adjourn this case sine die (indefinitely),&#8221; she declared.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Kanu, however, rejected the ruling, arguing that the judge lacked jurisdiction to make any decision on the case.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\u00a0&#8220;You have no jurisdiction to adjourn anything.
